Terms of Service

These Terms of Service ("Terms") govern your access to and use of MDL Match's website, API, and related services (collectively, the "Service"). By accessing or using the Service, you agree to be bound by these Terms.

1. Acceptance of Terms

By creating an account or using the Service, you agree to these Terms and our Privacy Policy. If you are using the Service on behalf of an organization, you represent that you have authority to bind that organization to these Terms.

2. Description of Service

MDL Match provides a platform that matches case details against active federal Multi-District Litigation (MDL) dockets. The Service includes:

• Web-based dashboard for case matching
• API access for programmatic integration
• MDL registry browsing and search
• Case history and saved matches

3. Account Registration

To use the Service, you must:

• Provide accurate and complete registration information
• Maintain the security of your account credentials
• Promptly notify us of any unauthorized access
• Be a licensed attorney or authorized representative of a law firm

You are responsible for all activity that occurs under your account.

4. Subscription and Payment

Fees

Access to the Service requires a paid subscription. Fees are based on your selected plan and are billed monthly or annually in advance. Current pricing is available at mdlmatch.ai/pricing.

Payment Terms

• Payment is due at the beginning of each billing cycle
• All fees are non-refundable except as required by law
• We may change pricing with 30 days notice
• Failure to pay may result in suspension of access

API Usage

API access is metered by query volume. Overages beyond your plan limits are billed at the published per-query rate.

5. Acceptable Use

You agree not to:

• Use the Service for any unlawful purpose
• Submit false or misleading case information
• Attempt to reverse engineer or copy the Service
• Interfere with the security or integrity of the Service
• Resell or redistribute access without authorization
• Use automated tools to scrape or extract data
• Exceed your plan's usage limits without payment

6. Intellectual Property

Our Property

The Service, including all software, algorithms, data compilations, and user interfaces, is owned by MDL Match and protected by intellectual property laws. Your subscription grants a limited, non-exclusive license to use the Service.

Your Data

You retain ownership of case data you submit. By using the Service, you grant us a limited license to process your data solely to provide matching results.

7. Disclaimers

No Legal Advice

MDL Match is a research and screening tool. Match results are not legal advice and do not constitute an attorney-client relationship. You are solely responsible for evaluating case viability and making litigation decisions.

Accuracy

While we strive for accuracy, we do not guarantee that MDL data, match results, or qualifying criteria are complete, current, or error-free. You should independently verify all information.

Service Availability

We do not guarantee uninterrupted access to the Service. We may perform maintenance, updates, or experience outages.

8. Limitation of Liability

TO THE MAXIMUM EXTENT PERMITTED BY LAW, MDL MATCH SHALL NOT BE LIABLE FOR ANY INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, OR PUNITIVE DAMAGES, INCLUDING LOSS OF PROFITS, DATA, OR BUSINESS OPPORTUNITIES.

OUR TOTAL LIABILITY FOR ANY CLAIMS ARISING FROM THESE TERMS OR YOUR USE OF THE SERVICE SHALL NOT EXCEED THE FEES YOU PAID IN THE TWELVE MONTHS PRECEDING THE CLAIM.

9. Indemnification

You agree to indemnify and hold harmless MDL Match and its officers, directors, employees, and agents from any claims, damages, or expenses (including reasonable attorneys' fees) arising from your use of the Service or violation of these Terms.

10. Termination

By You

You may cancel your subscription at any time through your account settings. Cancellation takes effect at the end of your current billing period.

By Us

We may suspend or terminate your access if you violate these Terms or for any other reason with 30 days notice. We may terminate immediately for serious violations.

Effect of Termination

Upon termination, your right to use the Service ends. We may delete your data after a reasonable retention period.

11. Changes to Terms

We may modify these Terms at any time. We will notify you of material changes via email or through the Service. Continued use after changes constitutes acceptance.

12. General Provisions

Governing Law

These Terms are governed by the laws of the State of California, without regard to conflict of law principles.

Dispute Resolution

Any disputes shall be resolved through binding arbitration in San Francisco, California, under the rules of the American Arbitration Association.

Entire Agreement

These Terms, together with our Privacy Policy, constitute the entire agreement between you and MDL Match.

Severability

If any provision is found unenforceable, the remaining provisions continue in effect.

No Waiver

Failure to enforce any provision does not waive our right to enforce it later.
